Woman Fights To Give Birth To Own Grandchild Using Dead Daughter’s Eggs

A British woman has vowed to continue her fight to give birth to her own grandchild using her dead daughter’s frozen eggs.

The woman (60) and her husband, referred to in court as Mr and Mrs M’ to protect their identities, have petitioned the court of appeal to overturn a High Court decision made in June of last year, effectively banning them from taking the eggs to a US fertility clinic and fertilising them using donor sperm.

The distraught couple began the legal process in 2011 when their daughter, who they claim asked her mother to ‘carry my babies’, lost her battle with cancer.

Because the daughter, referred to in court as ‘A’, did not provide written consent before her death, the London-based Human Fertilisation and Embryology Authority (HFEA) have argued that the eggs cannot be released from storage.

This week the court heard that ‘A’ would have been ‘devastated’ to know that her eggs could not be released to her mother after her death.

The judges said they would consider the arguments for appeal and make their decision at a later date.

If the couple succeed in winning the case and a baby is born using the eggs, it will be the first time in history a woman has given birth to her grandchild using the eggs of a dead daughter.
