A gay man in the UK is suing the woman who carried his baby as a surrogate for keeping the child after giving birth.

The man and his partner, a man in his seventies, wanted to have a baby and contacted a surrogacy agency.

They met this woman through the agency and she agreed to carry their baby, using sperm from the younger man.

However, the older man in the couple died during the pregnancy and the woman decided to keep the baby, reports The Sun.

The man was reportedly kept from the baby’s birth and hasn’t been allowed to see the child.

British law recognises the woman in surrogacy cases as the mother of the child and gives her the right to the child.

The man contends that the woman has broken the terms of their surrogacy agreement by refusing to hand over the baby.

“It’s extremely rare for a surrogate mother to refuse to hand over the child after birth,” a source said.

“She took the view the child was no longer going to a loving couple.

“She formed a bond with him when pregnant and thinks she’s doing the right thing.”
